LOL. In most states it is illegal to text and drive. Even if in your state it is not illegal, then the phone company can't be responsible for a person not paying attention by taking their eyes off the road and rear ending you. There's NO law that says that because a phone call comes in or a text, you must answer it.
The good news is that he rear ended you, regardless of the reason, thus his insurance will pay for your damages.
