Why is my co-signer responsible if they didn't sign the lease i signed without them?
I moved into an apartment with my dad in 2014 and live here since. I signed a new lease with no co-signer, but I'm financially poor and can't afford rent. I did receive a letter saying the co-signer would have to pay if I couldnt. I can't let them pay as they are my family and have a family to feed.
If nobody else signed the new lease, nobody else is responsible. They can threaten your Dad who signed the old lease but they legally can't touch him.
That is what they agreed to when they cosigned for you. When you started with a cosigner they do not get released when you sign a new lease. The cosigner remains effective as long as you live there. The cosigner agreement is separate from your lease.
Now if by cosigner you are referring to your dad that was on the 1st lease with you then he was your roommate not your cosigner. In this case dad would not remain responsible since he is not on the new lease. In this case you need to dispute that letter.
A second person on the same lease is not a cosigner. A cosigner typically does not sign the lease. They sign a separate cosigner agreement. Don't know if it is different in other states but that is how we do it here in Oregon.
When someone agrees and signs they remain legally responsible for as long as you live there regardless of contract renewals the two things area separate rent payment guarantor and contract… Not sure who you expect will pay your rent if you don't, your guarantor will have to or be taken with you to court, the landlord is not responsible to pay for you.
So what you do is get second jobs obviously
If there's no co-signer on your current lease, regardless of who was on an old one, then the letter you received is pretty irrelevant. Nobody is legally responsible except you.
If they didn't sign the lease, then they are not a cosigner. If you can't let them pay.simple, make sure you pay the rent.
do you mean you live by yourself but dad cosigned in 2014? If you really signed a new lease alone, dad can't be held responsible. But that won't stop the landlord from suing him.
why are you living above your means? You need to move back in with dad or find a roommate.
If the co-signor didn't sign anything saying they would be financially responsible then they aren't a co-signor. If they signed something else saying they would be then they are, whether or not their name is on the lease unless your state's laws say differently.
If the consigned is not on the new lease they do not have to pay
If you signed a new lease - the old co-signer is no longer responsible
As each lease expires and a new lease is signed that has precedence over any past ones, if he didn't sign the new lease he is not a co signer and not responsible
- Isn't it priceless that none other than Diane Feinstein herself will be responsible for the confirmation of JUSTICE BRETT KAVANAUGH? I guess sitting on Christine Ford's silly little story until the 11th hour turned out to be a GREAT BIG FAIL!
- If Graham is so upset about people making charges without evidence then why is he accusing Ford of lying without any evidence and the DNC? "putting her up to it" with no evidence for that claim either? Privately? Why? These are public hearings and a lifelong appointment. If somebody's going to speak up they'd better do it now.
