How can I dispute State Farm for a auto claim?
Basically I went thru some construction last month and I ran into and over some cement / metal cubes in the road… My muffler was knocked loose and broke and car began shaking immediately and then wen I got home ( less than a mile away) I parked my car… A few hours later the car wouldn't start… So I filed a claim… It was towed to a select service shop and they could fix it, wanted to send it to ford… Instead I asked if they could take it to the dealership where I bought the car they said yes…
It took them 2 weeks to get an adjuster out to look at my car… By this time. The shop had already began working on my car because they know me being that I got it from them…
So now State Farm is telling me they will only pay for the muffler being fixed… Out of about 1300 dollars they only want to pay out Saying that the other damage could have been done prior…
That can't be true because after the accident all this mess started happening, fuel pump was broke into pieces… Just had both pumps replaced in March, tie rod was messed up. And other minor things… Please help… I'm not liking State Farm and this process has been **** … It has been since June 13th…
I'm guessing that you have a $500 deductible, so that would leave $800 owing from State Farm to pay.
The biggest problem you have, is that you authorized the shop to go ahead with the repairs, (before) State Farm agreed to pay or not to pay.
The dealer/shop should have sent over an estimate w/in the same day or next to the adjuster, and I'm guessing they were questioning if all of the damages were accident related or just prior mechanical problems not caused by the accident.
Yes, you have the right to take you car to the shop of your choice, but, for insurance to pay, they must authorize 1st, which they did not. Granted the 2 week delay is not normal, and they should have had an appraiser w/in 3 days to see. State Farm a mega insurance company would have appraisers working for them, or hire an outside one to look at it.
2 options. Have Ford fight with the adjuster to verify that the damages were from the accident, since they should. But, if they won't, then "suspect" they knew that this was a problem prior.
Or, can file a complaint with the State Insurance Department in the state where you live, against State Farm, and then they will have to answer why they denied.
The biggest argument you have is of the 2 week delay of them not seeing the vehicle. Or, if, Ford, or the body shop did not inform you that there could be problems with this claim, if it would be covered or not.
