What's considered structural damage to a car in New York?

I'm looking at purchasing a 2012 Ford Fusion from a dealership. The car was previously a lease in NY and was sold at an auction in PA. The dealer provided a car fax for the car and it states there's structural damage to the vehicle. I called and spoke to the dealership sales rep and he said NY and NJ consider damage to the outside of the car structural damage a well. There's a small crack on the bottom of the front bumper (looks like driver bottomed our turning) and the driver side mirror is cracked (they are replacing).

There's no accident or air bag deployments reported on the car fax. Car fax also guarantees that it was not salvaged or rebuilt.

So, my question is, is he telling the truth that NY & NJ consider structural damage when the car is damaged on the outside? Like the cracked mirror and cracked bumper?

Just to be clear, the crack in the bumper is very minor and the only part on the mirror that is broken is the actual mirror (spider cracks). The part that hold the mirror to the car is not damage.

Sorry, I should have clarified a little more. In NY or NJ, do they consider structural damage, damage to the exterior of the car as well as damage to the frame?

Is he telling the truth? How could anybody possible know that unless they know their policy on damage, structurally or otherwise.
This should be an advantage to you as damage should lower the price some.

I wouldn't even consider buying this car. Structural damage to me means frame. Nothing to do with fenders, paint or interior. Find something else

This would indicate a major accident, Structural damage would include framework, suspension, unibody warpage, etc. If the car has been professionally repaired including any frame/body straightening, and suspension replacement, it may be a decent car.
Minor body, bumper, accessory mishaps alone would not constitute 'structural' damage.
This consideration is not limited to NY, NJ. It is nationwide.

  • If a car causes another car to swerve and spin-out, is it considered hit-and-run if they leave the scene? On the way to work this morning, I saw a Ford truck cut off a smaller car and the poor car spun out in the rain and ended up facing the opposite direction. This caused the traffic to stop because it looked like the vehicle wouldn't start. The ford truck most likely knew he did that but kept going, instead of stopping. He didn't hit the car or any cars at all during the time. If he didn't actually hit anything, is it still considered hit and run? Should he have stopped?
  • What is considered an upgrade for my car stereo? I have a 2005 Ford Focus SES. It came with all stock audio systems. I already installed a new Pioneer bluetooth double din receiver in the car, but want a little more bass and volume. I don't want to go as far as a sub, but perhaps just some bigger nicer speakers than stock. I can't find what the stock speakers are though. What should I look for that would be an upgrade? But not totally crazy or expensive. Just want to replace the 4 in-door speakers.
