Construction company totaled my car, will they rent me one?

Briefly, construction zone, a worker was moving equipment (a lift) in the one open lane (no lights on it). He didn't tell foreman to have the cop posted there to block the lane. The lift was about 5 feet up and it hit it at maybe 25 mph. The worker was not harnessed in so was thrown about 20 feet but injuries seem to be mild to none (he was taken away by ambulance).

My car is not worth much (1995 Ford minivan) and suffered severe damage to right windshield post and roof and windshield. I figure the insurance company of the construction company will look it up in the blue book and say "totaled, here's your check for $1,000.

Meanwhile, I'm suffering a damage in that I have to drive to work and already will be losing today (the accident happened 0245 AM).

I don't know how long it will take for the insurance company to decide what to do, I had car towed to a local body shop which will get $ from insurance to pay the tow truck. Meanwhile, do you think they will rent me a car?

I was not injured but this fiasco is ruining my whole day and probably the next week or so, since I can't afford to actually go buy another car (don't know, haven't thought that far ahead yet)…

Normally, they'd pay for a rental for a "reasonable" period of time for you to buy a new car. With an auto claim, that would be about a week or so. Since you're looking at their general liability coverage rather than auto, it takes a bit longer.

If you rent your own car, the cheapest you can find, and ask for the insurance discount at Enterprise, they'll reimburse you about $25 a day, for up to a week.

Go buy that new car As soon as possible.

The loss of wages because you don't have a car to get to work - not compensible.

The insurance co should let you rent a car, but if the car is totaled they may just give you the money to buy another car with no rental, that is what they did to me.

Good to hear no one was seriously hurt. But you need to change insurance companies if a simple phone call to (your) insurance company wouldn't answer any and all questions re the accident and rentals etc.(yes, even though the const co's insurance has to cover this one). I've been with State Farm forever and wouldn't hesitate to call them if I were in your situation.

@What's UP: There was a cop there, parked in the closed lane, lights flashing. However, he is not there by law, he is there because whoever is running this project HIRES the cops to be there. The worker failed to notify the foreman who therefore did not inform the cop to close the lane while equipment is being moved. This project has been going on for well over a year so they all know the drill. Speed limit was 45 and I was going maybe 25. Just didn't expect anything in the air, I was looking at the ground. I'm not at fault here. I did everything right, "they" messed up.
My insurance company will probably not be involved, will be ins co of construction company.
My car is old and not worth much so have liability and medical only.

EVEYONE IS INSURED BY LAW, So THE INSURANCE COMPANIES WILL NEGOTIATE A SETTLEMENT, CONTACT YOUR AGENT TO CONTACT THEIR AGENT AND GET R DONE.
