What legal actions can I take?

I purchased a used truck a little over 2 months ago. It had a 30 day 50/50 parts and labor warranty on it. After 5 days I found out it needed the engine to be replaced. I took it back and after 5 weeks I finally got it back. I paid over $2k for my half of a remanufactured motor that is under warranty. While driving it home the transmission light comes on. I make an appointment with ford to have it looked at, but before I can get it to them, the truck just stalls out on me while crossing an intersection. I take it back to the lot again and they have it for a week and said there was a loose ground wire and that's all they could find. While driving home once again it dies on me again a split second before I'm about to pull onto the highway. It started back up and died on me once more while going back to the car lot. It's been 2 weeks now and I haven't heard a word. I was told warranty papers for the motor would be sent to me, and all I received was info from an engine rebuilding company that was printed up straight from their website. Is there any legal action that I can take to get my money back for cost of truck and repairs (that can't be verified)? I live in Va. Any input would be much appreciated.

Added (1). I failed to mention that in over two months period of time, I have had the truck for less than 2 weeks in my possession.

No. It is part of the risk of buying a used car.

I think you are out of luck on a used vehicle

Did you have it inspected by your mechanic beforehand? A bad engine and a bad transmission should easily have been identified.

Doesn't look like they cover used cars, some states do.

The most common type of implied warranty is the warranty of merchantability: The seller promises that the product offered for sale will do what it's supposed to. That a car will run is an example of a warranty of merchantability. This promise applies to the basic functions of a car. It does not cover everything that could go wrong.

Breakdowns and other problems after the sale don't prove the seller breached the warranty of merchantability. A breach occurs only if the buyer can prove that a defect existed at the time of sale. A problem that occurs after the sale may be the result of a defect that existed at the time of sale or not. As a result, a dealer's liability is judged case by case.

At this point, you might want to consider small claims court. You present your evidence, the dealer presents their evidence.

On the purchase of a used car? No.

However, they offered you a warranty and the new/rebuilt engine, there should be a warranty also. Even though the 30 day warranty has expired, you might have some leeway because you have not had the use of the car because of its condition and the repairs that have had to be effected, that the warranty may, in fact still be in effect.

However, that is really up to VA law. At this point, I would be back at the dealership insisting they make this right, perhaps by taking this piece of shxt back and refunding the initial purchase price at minimum. You would be out half the engine cost, but in the end I think that will be cheaper than any way forward. This car is a money pit.

Your other alternative is to contact an attorney. That may cost you as much as the engine, so weight your alternatives carefully

Looking at your previous questions it would appear you have nothing but bad luck with used vehicles, Personally I'm a mechanic and drive a 06 Nissan Frontier I bought new, Have never had a problem, and in the long run have probably spent less than you in lost time at work, Provided you have a job, and the purchase and repair of someone else's problem

  • Suggestions for Ford Mustang GT CA smog legal exhaust system? I just purchased a 2005 Mustang GT, and I'm looking to improve the sound while still being California emissions legal. Don't know much about exhaust tuning… I love how some cars crackle and pop on liftoff. What can I do to get that? Upgrading performance and cost aren't a big deal to me, I just want it to sound better than stock and give it some more noise.
