I was in a car crash can I sue?

I was in a car crash it was marked as a total loss and there fault. There was some hospital bills only like 3k. The other persons insurances is paying for it and what not but the person that crashed in to me did not have a valid driver's license ( driving on a learners permit with out anyone in the car), ran a stop sign and did not clean all the ice off there windows to the point where the cops gave them a ticket for that to. I was wanting to know if there's anything I can sue?

Added (1). Just to add because I did forget to add it there insurances is only paying 5K for a 2015 ford fiesta as a total loss car had 5001 miles on it

You can sue a family for falling through their roof for being unstable, when you were planning on burglarizing it.
And you can even win some of these cases, apparently.
So sure, you can sue. "Can you win?", I think is the more appropriate question.

But keep in mind that suing is a real action with a real consequence. If you feel obligated then it doesn't hurt to try. They're already paying your medical bills. What exactly would you sue for? You said their insurance is paying for it. So what would you expect to sue for? No, you can't sue. You actually have to pay for medical treatment after an auto accident? What backward Country is this surely not the USA? Jesus… You're kinda ****** up haha if the insurance is paying for everything why do you want to sue - is it vengeance or greed It's very common for insurance companies to try to low ball you. They take advantage of the fact that people don't know that you don't have to accept the insurance companies first offer.

You need to get a lawyer and sue the INSURANCE COMPANY. Or at least threaten to sue, and then they'll give you a decent amount.

You don't get to "double sue" the driver as well. You don't get to add on more law suits because the driver made this mistake or that mistake. That's just not how the law deals with car accidents. Most states are no fault states, so your insurance company is actually responsible for paying this claim
